IBACTP® Terms of Use

Rules and legal conditions governing use of IBACTP® websites, portals, examinations, certifications, and candidate accounts.

Policy Overview

Introduction & Scope

These Terms of Use (“Terms”) govern access to and use of the websites, portals, applications, certification programs, examinations, training programs, digital credentials, materials, services, and other offerings provided by the International Board of AI, Cybersecurity & Technology Professionals (IBACTP®).

In these Terms, “IBACTP,” “we,” “us,” and “our” refer to the International Board of AI, Cybersecurity & Technology Professionals. “You” and “your” refer to any visitor, applicant, candidate, participant, credential holder, instructor, partner, employer, university, organization, or other person or entity using an IBACTP service.

Please read these Terms carefully. By accessing an IBACTP website, creating an account, submitting an application, registering for an examination, purchasing a service, participating in training, accepting a credential, or otherwise using an IBACTP service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the applicable IBACTP service.

Section 1

About IBACTP®

IBACTP is a professional certification organization offering vendor-neutral credentials, examinations, education, training, professional-development programs, credential-verification services, and organizational programs in areas including:

  • Artificial intelligence;
  • Cybersecurity;
  • Digital forensics;
  • Data science;
  • Cloud computing;
  • Information technology;
  • Technology management; and
  • Related professional disciplines.

IBACTP may provide services directly or through authorized examination providers, instructors, training partners, technology vendors, digital credential providers, universities, employers, and other approved organizations.

Section 2

Scope of These Terms

These Terms apply to:

  • Public IBACTP websites;
  • Candidate and credential-holder portals;
  • Certification applications;
  • Eligibility reviews;
  • Certification examinations;
  • Remote and in-person proctoring;
  • Self-paced training;
  • Virtual instructor-led training;
  • In-person instruction;
  • Practical laboratories;
  • Projects and capstone assessments;
  • Management simulations;
  • Continuing professional development;
  • Credential renewal;
  • Digital certificates and badges;
  • Credential-verification services;
  • Organizational and university programs;
  • Authorized training-partner programs;
  • Conferences, webinars, and events;
  • Publications and downloadable resources;
  • Customer support; and
  • Other services that link to these Terms.

Some services may be subject to additional terms, policies, candidate handbooks, examination rules, program requirements, partner agreements, order forms, or contracts.

When additional terms apply, they form part of the agreement between you and IBACTP. If there is a conflict, the more specific terms governing the relevant service will apply to that conflict.

Section 3

Acceptance and Authority

By using an IBACTP service, you represent that:

  • You have read and understood these Terms;
  • You have legal capacity to enter into a binding agreement;
  • The information you provide is accurate and complete;
  • You will comply with applicable laws and IBACTP policies; and
  • You will use IBACTP services only for lawful and authorized purposes.

If you use an IBACTP service on behalf of an employer, university, government agency, training provider, or other organization, you represent that you have authority to bind that organization to the applicable terms.

If you do not have that authority, you may not accept these Terms on the organization’s behalf.

Section 4

Eligibility and Age Requirements

IBACTP services are intended primarily for adults, university students, and working professionals.

You must be at least 18 years old to create an account or enter into a purchase directly unless:

  • The applicable program permits participation by a minor;
  • A parent, guardian, school, or authorized sponsor provides any required approval;
  • Appropriate supervision is available; and
  • Participation is permitted by applicable law.

Certification programs may have separate eligibility requirements based on:

  • Education;
  • Professional experience;
  • Prior certification;
  • Training completion;
  • Management responsibility;
  • Practical experience;
  • Ethical standing; or
  • Other published criteria.

IBACTP may require reasonable documentation to verify eligibility.

Eligibility approval does not guarantee that a candidate will pass an examination, earn a certification, receive employment, obtain promotion, qualify for a license, or receive any other professional benefit.

Section 5

Accounts and Registration

Some services require an account.

You agree to:

  • Provide truthful and current information;
  • Maintain accurate account information;
  • Create only one personal candidate account unless authorized otherwise;
  • Protect your username and password;
  • Use multifactor authentication when required;
  • Prevent unauthorized account access;
  • Notify IBACTP promptly of suspected compromise;
  • Accept responsibility for activity conducted through your account; and
  • Log out when using a shared or public device.

You must not:

  • Create an account using another person’s identity;
  • Share your account with another person;
  • Permit another person to take an examination or complete an individual assessment for you;
  • Purchase, sell, transfer, or trade an account;
  • Circumvent authentication or security controls;
  • Use automated tools to create accounts; or
  • Access an account without authorization.

IBACTP may require identity verification before granting access to certain services.

Section 6

Accuracy of Information

You are responsible for ensuring that information submitted to IBACTP is accurate, complete, current, and not misleading.

This responsibility applies to:

  • Names and contact information;
  • Education;
  • Employment;
  • Professional experience;
  • Certifications;
  • Continuing-development records;
  • References;
  • Accommodation requests;
  • Identity documents;
  • Assessment submissions;
  • Organizational information; and
  • Partner applications.

IBACTP may verify submitted information directly or through authorized third parties.

Providing false, altered, incomplete, or misleading information may result in:

  • Rejection of an application;
  • Cancellation of registration;
  • Invalidation of an examination result;
  • Suspension or revocation of certification;
  • Termination of partner status;
  • Loss of access;
  • Referral to an employer, sponsor, regulator, or law-enforcement authority where legally appropriate; or
  • Other action permitted by applicable policy or law.
Section 7

Limited Permission to Use IBACTP Services

Subject to these Terms, IBACTP grants you a limited, personal, nonexclusive, nontransferable, revocable right to access and use its services for their intended purposes.

This permission does not transfer ownership of any IBACTP content, examination material, certification mark, software, curriculum, publication, or other intellectual property.

You may not use an IBACTP service in a manner that:

  • Violates these Terms;
  • Violates applicable law;
  • Infringes another person’s rights;
  • Compromises examination security;
  • Interferes with service availability;
  • Misrepresents certification status;
  • Enables fraud;
  • Introduces malicious code; or
  • Causes harm to IBACTP, its users, partners, or the public.
Section 8

Certification Applications

Submitting an application does not guarantee:

  • Eligibility;
  • Approval;
  • Examination admission;
  • Certification;
  • Renewal;
  • Employment;
  • Promotion;
  • Compensation;
  • Professional licensing;
  • Security clearance;
  • Expert-witness qualification;
  • Government authority; or
  • Acceptance by an employer, regulator, university, or professional body.

IBACTP may:

  • Request additional information;
  • Verify qualifications;
  • Contact references;
  • Review professional or disciplinary information;
  • Require clarification;
  • Place an application on hold;
  • Reject an incomplete application; or
  • Deny eligibility when published requirements are not met.

Applicants are responsible for submitting required information before applicable deadlines.

Section 9

Certification Examination Terms

9.1 Standard examination format

Unless a certification page or Candidate Handbook states otherwise, IBACTP certification examinations consist of:

  • 100 multiple-choice questions;
  • 90 minutes of testing time;
  • Knowledge-based, applied, interpretive, scenario-based, or management-decision questions; and
  • A passing score established by IBACTP.

IBACTP may include unscored or pilot questions for examination-development purposes. If used, such questions will not negatively affect a candidate’s score.

9.2 Examination rules

Candidates must:

  • Complete identity-verification requirements;
  • Follow proctor instructions;
  • Use only authorized materials;
  • Remain within the approved testing environment;
  • Avoid communicating with unauthorized persons;
  • Protect examination confidentiality;
  • Refrain from recording examination content;
  • Stop when testing time expires;
  • Report technical issues promptly; and
  • Comply with the applicable Candidate Handbook.

9.3 Prohibited examination conduct

Prohibited conduct includes:

  • Impersonation;
  • Receiving or providing unauthorized assistance;
  • Possessing unauthorized notes or devices;
  • Copying, photographing, recording, memorizing for distribution, or reconstructing questions;
  • Sharing examination content;
  • Using unauthorized websites, software, or AI tools;
  • Communicating with another person during testing;
  • Removing examination materials;
  • Accessing leaked or stolen questions;
  • Attempting to manipulate scores;
  • Disrupting a testing system;
  • Providing false identity information;
  • Offering or accepting payment for examination content;
  • Circumventing proctoring controls; and
  • Assisting another person in violating examination rules.

9.4 Examination interruptions

If an examination is interrupted by a verified technical or administrative problem, IBACTP or the testing provider may:

  • Resume the examination;
  • Reschedule the examination;
  • Provide another attempt;
  • Investigate the interruption; or
  • Take another reasonable corrective action.

IBACTP is not responsible for interruptions caused by a candidate’s unsupported equipment, unstable internet connection, failure to complete system checks, power loss, prohibited software, or unsuitable testing environment, except where applicable law requires otherwise.

9.5 Examination results

Examination results are subject to:

  • Identity verification;
  • Security review;
  • Score validation;
  • Payment completion;
  • Eligibility confirmation; and
  • Resolution of any testing irregularity.

A preliminary score or on-screen result is not final if an examination is under security or administrative review.

9.6 Retesting

Candidates who do not pass may retest according to the applicable:

  • Waiting period;
  • Attempt limit;
  • Eligibility period;
  • Registration process;
  • Fee requirement; and
  • Candidate Handbook.

IBACTP may impose additional conditions when examination-security concerns exist.

Section 10

Training and Educational Programs

IBACTP may offer:

  • Self-paced learning;
  • Virtual instructor-led training;
  • In-person training;
  • Practical laboratories;
  • Case studies;
  • Simulations;
  • Capstone projects;
  • Examination preparation;
  • Corporate training; and
  • University or partner-delivered programs.

Training may improve preparation but does not guarantee:

  • Examination success;
  • Certification;
  • Employment;
  • Promotion;
  • Salary increases; or
  • Professional competency beyond the learning outcomes assessed.

Participants must:

  • Complete their own work unless collaboration is authorized;
  • Follow instructor directions;
  • Respect other participants;
  • Protect confidential information;
  • Use laboratory systems only as authorized;
  • Comply with academic-integrity requirements; and
  • Properly acknowledge external sources and permitted AI assistance.
Section 11

Capstone Projects and Applied Assessments

A capstone project may be required for participants enrolled in a five-day virtual instructor-led program or another designated pathway.

Participants must not include:

  • Confidential employer information;
  • Personal information about another individual;
  • Proprietary datasets;
  • Active investigative evidence;
  • Regulated information;
  • Security credentials;
  • Malicious code;
  • Restricted technical information; or
  • Materials they are not authorized to use.

Participants are responsible for obtaining any necessary permission before using organizational information.

IBACTP may use submitted work to:

  • Evaluate competency;
  • Conduct originality reviews;
  • Investigate academic misconduct;
  • Perform quality assurance;
  • Train evaluators;
  • Resolve appeals; and
  • Improve assessment design.

IBACTP will not publicly distribute an identifiable capstone submission without authorization, except where disclosure is required by law or necessary to investigate misconduct.

Section 12

Artificial Intelligence in Training and Assessment

IBACTP may permit, restrict, or prohibit AI tools depending on the activity.

Participants must follow the instructions provided for each:

  • Examination;
  • Assignment;
  • Laboratory;
  • Project;
  • Capstone;
  • Simulation; or
  • Professional submission.

When AI assistance is permitted, participants remain responsible for:

  • Accuracy;
  • Originality;
  • Source verification;
  • Citation;
  • Confidentiality;
  • Security;
  • Ethical use; and
  • Compliance with applicable instructions.

Participants must not use AI to:

  • Complete a closed-book examination;
  • Impersonate another person;
  • Generate fraudulent qualifications;
  • Falsify experience;
  • Conceal plagiarism;
  • Obtain or reconstruct confidential examination content;
  • Process confidential or personal information without authorization; or
  • Misrepresent AI-generated work as independently completed when disclosure is required.

IBACTP may require disclosure of AI tools used, prompts submitted, outputs incorporated, and verification performed.

Section 13

Academic and Professional Integrity

Participants, candidates, credential holders, instructors, and partners must act honestly and professionally.

Misconduct may include:

  • Plagiarism;
  • Fabrication;
  • Falsification;
  • Impersonation;
  • Unauthorized collaboration;
  • Misrepresentation;
  • Submission of purchased work;
  • Prohibited AI assistance;
  • Theft or distribution of examination content;
  • Alteration of records;
  • Credential misuse;
  • Harassment;
  • Discrimination;
  • Retaliation;
  • Conflict-of-interest concealment; and
  • Violation of the IBACTP Code of Ethics.

IBACTP may investigate suspected misconduct and impose proportionate action under applicable policies.

Section 14

Examination Security and Investigations

IBACTP may review:

  • Examination-session recordings;
  • Proctor reports;
  • Device and network data;
  • Candidate responses;
  • Answer patterns;
  • Testing times;
  • Similarity reports;
  • Account records;
  • Payment information;
  • Prior attempts;
  • Communications;
  • Submitted work; and
  • Other relevant information.

An examination result may be delayed, withheld, invalidated, or canceled when reliable evidence indicates:

  • Impersonation;
  • Unauthorized assistance;
  • Exposure to examination content;
  • Prohibited materials;
  • Security circumvention;
  • Fraud;
  • Technical manipulation; or
  • Another material rules violation.

Before a materially adverse final decision, IBACTP should provide notice and an opportunity to respond or appeal, subject to confidentiality, safety, examination security, and legal limitations.

Section 15

Certification Awards and Credential Status

A certification is awarded only after all applicable requirements are satisfied.

Requirements may include:

  • Eligibility approval;
  • Payment;
  • Examination success;
  • Capstone completion;
  • Training completion;
  • Ethics acceptance;
  • Identity verification; and
  • Resolution of security or disciplinary reviews.

A credential may have an expiration date and may require:

  • Continuing professional development;
  • Renewal fees;
  • Ethics compliance;
  • Updated information; and
  • Periodic renewal applications.

IBACTP may classify a credential as:

  • Active;
  • Expired;
  • Suspended;
  • Revoked;
  • Retired;
  • Inactive; or
  • Under review.

Credential holders must not represent an expired, suspended, revoked, or otherwise inactive credential as current.

Section 16

Proper Use of Credentials

A credential holder may accurately state that they hold an IBACTP certification while the credential remains active and in good standing.

Credential holders must not:

  • Misstate the certification title;
  • Alter the credential name;
  • Claim a certification they have not earned;
  • Suggest that certification is a professional license;
  • Claim law-enforcement or governmental authority;
  • Guarantee competence beyond the credential’s scope;
  • Imply IBACTP endorsement of an employer, product, service, or opinion;
  • Transfer a credential to another person;
  • Alter a certificate or digital badge;
  • Use an inactive credential as though it were active; or
  • Use a credential in a misleading advertisement.

IBACTP may require correction or removal of an inaccurate credential claim.

Section 17

Credential Verification

IBACTP may provide a public or controlled verification service.

Verification information may include:

  • Credential holder’s name;
  • Certification title;
  • Credential identifier;
  • Date of issuance;
  • Expiration date;
  • Renewal status; and
  • Current credential status.

Verification confirms IBACTP’s certification record. It does not guarantee:

  • Employment performance;
  • Professional conduct;
  • Licensing;
  • Legal authority;
  • Security clearance;
  • Suitability for a particular role; or
  • Continued competency outside certification-maintenance requirements.

Employers and other users remain responsible for conducting appropriate due diligence.

Section 18

Fees, Taxes, and Payment

Prices are displayed in the applicable registration, order, invoice, or agreement.

You agree to:

  • Pay all applicable fees;
  • Provide accurate billing information;
  • Pay applicable taxes unless a valid exemption applies;
  • Use an authorized payment method; and
  • Comply with payment-provider requirements.

IBACTP may:

  • Correct pricing errors;
  • Cancel an order affected by an obvious error;
  • Suspend services for nonpayment;
  • Recover chargeback costs arising from improper disputes; and
  • Use authorized providers to process payments.

Prices, fees, and available services may change prospectively.

Section 19

Refunds, Cancellations, Transfers, and Rescheduling

Refunds, cancellations, substitutions, transfers, and rescheduling are governed by the policy displayed at the time of purchase or in the applicable agreement.

Unless a specific policy states otherwise:

  • Fees may be nonrefundable after access to digital content is provided;
  • Examination fees may be subject to rescheduling deadlines;
  • Missed examinations may result in forfeiture of fees;
  • Training substitutions may require prior approval;
  • Completed services are not refundable;
  • Administrative fees may apply; and
  • Promotional or discounted purchases may have special restrictions.

Nothing in these Terms limits a mandatory refund or cancellation right provided by applicable law.

Section 20

Promotional Offers and Discount Codes

Promotional offers may be subject to:

  • Eligibility requirements;
  • Expiration dates;
  • Geographic limitations;
  • Program restrictions;
  • Quantity limits;
  • Nontransferability;
  • Excluded services; and
  • Separate terms.

Unless expressly permitted, offers may not be combined, exchanged for cash, resold, or transferred.

IBACTP may cancel a promotion affected by fraud, technical error, unauthorized distribution, or misuse.

Section 21

Authorized Training Partners and Instructors

Only organizations expressly approved by IBACTP may represent themselves as authorized IBACTP training partners.

Authorized partners and instructors must:

  • Use approved materials;
  • Accurately describe programs;
  • Avoid guaranteeing examination success;
  • Protect candidate information;
  • Maintain qualified instructors;
  • Comply with brand requirements;
  • Follow assessment-security rules;
  • Maintain accurate records;
  • Meet quality standards; and
  • Cooperate with authorized audits.

Partner status does not create an employment, agency, franchise, joint-venture, or legal partnership relationship unless a written agreement expressly states otherwise.

IBACTP may suspend or terminate partner status for quality failures, misrepresentation, misconduct, nonpayment, data-security concerns, or agreement violations.

Section 22

Corporate, University, and Sponsored Programs

An employer, university, government agency, or sponsor may register or pay for participants.

The sponsoring organization may receive program-related information disclosed in the applicable notice or agreement, such as:

  • Enrollment;
  • Attendance;
  • Completion;
  • Certification status; and
  • Results where appropriate.

Payment by a sponsor does not automatically entitle it to:

  • Detailed examination responses;
  • Private accommodation records;
  • Unrelated account information;
  • Personal communications; or
  • Information prohibited from disclosure by law.

Participants remain responsible for complying with IBACTP certification and examination requirements.

Section 23

Intellectual Property Ownership

IBACTP and its licensors own all rights, title, and interest in IBACTP materials, including:

  • Certification names;
  • Certification abbreviations;
  • Trademarks;
  • Logos;
  • Badges;
  • Examination questions;
  • Examination forms;
  • Candidate handbooks;
  • Study materials;
  • Course materials;
  • Presentations;
  • Videos;
  • Graphics;
  • Illustrations;
  • Website content;
  • Software;
  • Databases;
  • Competency frameworks;
  • Learning objectives;
  • Assessment methods;
  • Publications;
  • Policies; and
  • Other original content.

These materials are protected by copyright, trademark, trade-secret, contract, and other applicable laws.

No right is granted except the limited use expressly permitted by these Terms or a written agreement.

Section 24

Restrictions on IBACTP Materials

Without written authorization, you may not:

  • Copy;
  • Reproduce;
  • Republish;
  • Upload;
  • Distribute;
  • Translate;
  • Modify;
  • Adapt;
  • Sell;
  • License;
  • Rent;
  • Create derivative works;
  • Remove ownership notices;
  • Scrape;
  • Data mine;
  • Use for AI-model training;
  • Commercially exploit; or
  • Publicly display IBACTP materials.

You may not reproduce or distribute examination content under any circumstances unless expressly authorized in writing.

Downloading a resource for personal study does not transfer ownership or grant redistribution rights.

Section 25

Trademarks and Certification Marks

IBACTP®, its logos, certification names, abbreviations, badges, and related marks are trademarks, service marks, certification marks, or protected brand assets of IBACTP.

Authorized use must comply with IBACTP’s:

  • Credential-use policy;
  • Brand guidelines;
  • Digital-badge terms;
  • Partner agreement; and
  • Written instructions.

You must not:

  • Register a confusingly similar domain name;
  • Use a mark in a company or product name;
  • Create an unauthorized badge;
  • Alter an official logo;
  • Suggest false affiliation;
  • Imply endorsement;
  • Use a certification mark after expiration, suspension, or revocation; or
  • Use IBACTP branding in deceptive advertising.

IBACTP may require immediate correction or removal of unauthorized use.

Section 26

User Submissions

“User Submissions” include information, feedback, assignments, comments, documents, images, recordings, capstone projects, and other materials you submit.

You retain ownership of original content you lawfully own.

You grant IBACTP a limited, nonexclusive, worldwide license to host, store, reproduce, review, process, and display your submission only as reasonably necessary to:

  • Provide the requested service;
  • Evaluate the submission;
  • Administer certification;
  • Conduct quality review;
  • Investigate misconduct;
  • Resolve an appeal;
  • Maintain records;
  • Protect security; and
  • Comply with law.

This license does not authorize IBACTP to publicly market or commercially publish your identifiable submission without separate permission, except as required by law.

You represent that:

  • You have the right to submit the material;
  • The submission is accurate;
  • The submission does not infringe another person’s rights;
  • You have obtained required permissions;
  • The submission contains no unlawfully disclosed information; and
  • The submission complies with these Terms.
Section 27

Feedback

If you voluntarily provide an idea, recommendation, correction, or suggestion about an IBACTP service, you grant IBACTP permission to use that feedback without restriction or compensation.

This provision does not transfer ownership of your confidential materials, capstone work, or professional research.

Do not submit confidential business ideas as general feedback unless a separate written confidentiality agreement applies.

Section 28

Testimonials and Success Stories

IBACTP will not publish your name, image, statement, employer, examination result, or success story for promotional purposes without appropriate permission.

If you provide a testimonial, you agree that:

  • It reflects your honest experience;
  • You will disclose material relationships where required;
  • IBACTP may edit for length or clarity without changing the meaning;
  • IBACTP may withdraw misleading or outdated testimonials; and
  • No testimonial guarantees that another person will achieve the same outcome.
Section 29

Acceptable Use

You must not use an IBACTP service to:

  • Violate a law or regulation;
  • Infringe intellectual property;
  • Harass, threaten, discriminate against, or harm another person;
  • Submit malicious code;
  • Conduct unauthorized security testing;
  • Access systems or data without permission;
  • Interfere with website operation;
  • Overload infrastructure;
  • Scrape protected content;
  • Harvest personal information;
  • Send spam;
  • Conduct fraud;
  • Falsify records;
  • Impersonate another person;
  • Circumvent access controls;
  • Reverse engineer restricted software;
  • Distribute examination content;
  • Misuse a credential;
  • Train an AI model on protected content without authorization; or
  • Assist another person in prohibited conduct.

Authorized cybersecurity or digital-forensics laboratories must be conducted only within the systems, scope, and instructions provided.

Training in cybersecurity or forensics does not authorize access to third-party systems.

Section 30

Third-Party Services

IBACTP services may integrate with or link to third-party services, including:

  • Payment processors;
  • Testing platforms;
  • Proctoring providers;
  • Learning platforms;
  • Digital-badge platforms;
  • Video-conferencing services;
  • Cloud services;
  • Social networks; and
  • Partner websites.

Third-party services may be governed by their own terms and privacy notices.

IBACTP does not control and is not responsible for a third party’s independent services, content, availability, security, or conduct, except to the extent responsibility cannot lawfully be excluded.

A link does not necessarily constitute endorsement.

Section 31

Privacy

IBACTP’s collection and use of personal information are described in the IBACTP Privacy Policy.

By using an IBACTP service, you acknowledge that personal information will be processed as described in that Policy and any additional notice provided for a particular service.

If these Terms conflict with the Privacy Policy regarding the handling of personal information, the Privacy Policy will control that issue unless applicable law or a more specific agreement requires otherwise.

Section 32

Service Availability and Changes

IBACTP may:

  • Modify a website;
  • Update a curriculum;
  • Revise an examination blueprint;
  • Change a delivery platform;
  • Update eligibility requirements prospectively;
  • Retire a certification;
  • Replace outdated content;
  • Schedule maintenance;
  • Suspend a feature; or
  • Discontinue a service.

IBACTP will make reasonable efforts to provide appropriate notice when a material change affects registered candidates or active credential holders.

IBACTP does not guarantee that every service will always be:

  • Available;
  • Uninterrupted;
  • Error-free;
  • Compatible with every device;
  • Available in every country; or
  • Offered in every language.
Section 33

No Employment or Professional Guarantee

IBACTP certification does not guarantee:

  • Employment;
  • Promotion;
  • Compensation;
  • Client engagement;
  • Professional licensing;
  • Government appointment;
  • Security clearance;
  • Expert-witness status;
  • Admission to an academic program;
  • Regulatory approval;
  • Professional competence in every situation; or
  • Acceptance by a particular employer.

Employers and other organizations determine their own qualification requirements.

Certification validates specified knowledge or competencies assessed at a particular time. It does not replace professional judgment, experience, supervision, continuing education, or compliance with law.

Section 34

Educational and Informational Purposes

IBACTP materials are provided for certification, educational, and professional-development purposes.

They do not constitute:

  • Legal advice;
  • Financial advice;
  • Medical advice;
  • Employment advice;
  • Regulatory approval;
  • A guarantee of compliance;
  • Authorization to access a system;
  • Law-enforcement authority; or
  • A substitute for qualified professional advice.

Laws, regulations, technologies, and professional practices change. Users remain responsible for verifying current requirements and obtaining appropriate advice.

Section 35

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IBACTP SERVICES AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

IBACTP DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • TITLE;
  • NON-INFRINGEMENT;
  • ACCURACY;
  • COMPLETENESS;
  • AVAILABILITY;
  • SECURITY; AND
  • ERROR-FREE OPERATION.

IBACTP does not warrant that:

  • Every service will meet your requirements;
  • Every error will be corrected;
  • Services will be uninterrupted;
  • Third-party services will remain available;
  • Certification will produce a particular career outcome; or
  • All content will remain current indefinitely.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent legally permitted.

Section 36

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IBACTP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF:

  • PROFITS;
  • REVENUE;
  • DATA;
  • BUSINESS;
  • EMPLOYMENT OPPORTUNITY;
  • REPUTATION;
  • GOODWILL; OR
  • ANTICIPATED SAVINGS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IBACTP’S TOTAL LIABILITY ARISING FROM A SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID TO IBACTP FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT; OR
  • ONE HUNDRED U.S. DOLLARS IF YOU PAID NOTHING FOR THAT SERVICE.

These limitations do not apply where liability cannot lawfully be limited, including certain liability for fraud, willful misconduct, gross negligence, personal injury, or violation of mandatory consumer rights.

Section 37

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless IBACTP and its officers, directors, employees, contractors, and agents from third-party claims, damages, liabilities, judgments, penalties, losses, and reasonable expenses arising from:

  • Your unlawful use of a service;
  • Your violation of these Terms;
  • Your infringement of another person’s rights;
  • Your unauthorized submission of confidential or personal information;
  • Your misuse of an IBACTP credential or mark;
  • Your fraudulent or misleading conduct; or
  • Content you submit.

This obligation does not apply to the extent a claim results from IBACTP’s own unlawful conduct.

IBACTP may assume control of the defense of a claim subject to indemnification, and you agree to provide reasonable cooperation.

Section 38

Suspension and Termination

IBACTP may restrict, suspend, or terminate access when it reasonably believes that:

  • These Terms were violated;
  • Information was falsified;
  • Fraud occurred;
  • Payment remains due;
  • An account was compromised;
  • Examination security is threatened;
  • Intellectual property was misused;
  • A credential was misrepresented;
  • Another person may be harmed;
  • Legal compliance requires action; or
  • Continued access creates material security or operational risk.

Where appropriate, IBACTP will provide notice and an opportunity to respond.

Termination of website access does not automatically determine certification status. Certification suspension or revocation will follow applicable certification and disciplinary policies.

Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, examination confidentiality, disclaimers, liability, indemnification, disputes, and accrued obligations.

Section 39

Appeals and Complaints

Candidates and credential holders may submit appeals or complaints according to applicable IBACTP procedures.

An appeal must:

  • Be submitted within the published deadline;
  • Identify the decision being challenged;
  • Explain the basis of the appeal;
  • Include relevant supporting information; and
  • Be submitted through the approved channel.

An appeal does not guarantee reversal.

IBACTP may reject an appeal that is untimely, abusive, duplicative, unsupported, or outside the applicable review process.

Retaliation against an individual for submitting a good-faith complaint or appeal is prohibited.

Section 40

Copyright Complaints

IBACTP respects intellectual-property rights.

If you believe material available through an IBACTP service infringes your copyright, submit a written notice containing:

  • Your physical or electronic signature, or the signature of a person authorized to act for the copyright owner;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the allegedly infringing material and information sufficient to locate it;
  • Your name, mailing address, telephone number, and email address;
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • A statement, made under penalty of perjury,

Submitting a false or materially misleading copyright notice may create legal liability.

If IBACTP removes content in response to a copyright complaint, it may notify the person who submitted the material and provide information about any available counter-notification process.

IBACTP may terminate accounts belonging to repeat infringers when appropriate.

Section 41

Counter-Notifications

If you believe your material was removed or disabled because of a mistake or misidentification, you may submit a written counter-notification containing:

  • Your physical or electronic signature;
  • Identification of the material removed or disabled and its former location;
  • A statement under penalty of perjury that you have a good-faith belief the material was removed because of mistake or misidentification;
  • Your name, address, telephone number, and email address;
  • A statement consenting to the jurisdiction required under applicable copyright law; and
  • A statement that you will accept service of process from the person who submitted the original complaint or that person’s agent.

IBACTP may restore material when legally permitted unless the complaining party timely informs IBACTP that legal action has been filed.

Section 42

Confidentiality of Examination Content

All certification examination content is confidential.

Candidates must not:

  • Disclose examination questions;
  • Describe questions from memory;
  • Reconstruct examination forms;
  • Share answer choices;
  • Publish examination summaries containing protected content;
  • Record an examination;
  • Upload examination information to an AI system;
  • Use leaked questions;
  • Sell or purchase examination content; or
  • Assist another person in obtaining protected content.

These obligations continue after an examination ends and after a certification expires or is revoked.

General discussion of published examination domains is permitted. Disclosure of actual or substantially similar examination content is prohibited.

Section 43

Confidential and Restricted Information

You may receive access to confidential information through training, certification administration, partnership, investigation, or organizational programs.

You must:

  • Use the information only for its authorized purpose;
  • Limit access to authorized persons;
  • Apply reasonable security;
  • Avoid public disclosure;
  • Report suspected loss or misuse; and
  • Return or destroy information when required.

Confidential information does not include information that:

  • Becomes public through no violation of an obligation;
  • Was lawfully known without restriction;
  • Is received lawfully from another source; or
  • Is independently developed without using restricted information.

Examination content remains confidential regardless of whether similar topics are publicly discussed.

Section 44

Electronic Communications and Signatures

You consent to receive agreements, disclosures, notices, invoices, results, and other communications electronically, subject to applicable law.

Electronic acceptance, signatures, acknowledgments, and records may have the same effect as paper records and handwritten signatures.

You are responsible for maintaining a current email address and checking relevant account notifications.

You may request an available paper copy when required by law, although reasonable reproduction or delivery charges may apply where permitted.

Section 45

Notices

IBACTP may provide notice through:

  • Email;
  • An account message;
  • A website notice;
  • A portal notification;
  • Postal mail; or
  • Another reasonable method.

A notice sent to the contact information associated with your account will be considered delivered as permitted by applicable law.

You must keep your contact information current.

Section 46

Accessibility

IBACTP seeks to make its websites, training, and certification services reasonably accessible.

Individuals who require an examination or training accommodation should follow the applicable accommodation-request procedure and submit the request within the published timeframe.

IBACTP may request information reasonably necessary to evaluate and provide an accommodation.

An accommodation will not:

  • Eliminate an essential competency;
  • Reduce examination-security requirements unnecessarily;
  • Guarantee a passing score; or
  • Fundamentally alter the purpose of the certification.

Section 47

Export Controls and Sanctions

You may not use, export, re-export, transfer, or make available an IBACTP service in violation of applicable export-control, trade-control, or sanctions laws.

You represent that you are not prohibited from receiving the applicable service under laws binding on IBACTP.

IBACTP may decline or suspend a transaction when reasonably necessary to comply with trade restrictions, sanctions, payment restrictions, or legal obligations.

Section 48

Anti-Bribery and Ethical Business Conduct

You must not offer, request, authorize, give, or accept a bribe or improper benefit in connection with:

  • Certification;
  • Examination results;
  • Eligibility approval;
  • Partner authorization;
  • Training completion;
  • Vendor selection;
  • Credential renewal; or
  • Any other IBACTP decision.

Gifts, payments, employment offers, favors, or other benefits must not be used to improperly influence an IBACTP employee, instructor, evaluator, proctor, contractor, or partner.

Suspected misconduct should be reported to admin@ibactp.org.

Section 49

Conflicts of Interest

Individuals involved in examination development, instruction, evaluation, appeals, certification decisions, partner oversight, or disciplinary matters must disclose actual or potential conflicts of interest.

IBACTP may:

  • Reassign a reviewer;
  • Restrict access;
  • Require recusal;
  • Implement additional oversight; or
  • Take another reasonable protective measure.

Failure to disclose a material conflict may result in removal from the relevant activity or other appropriate action.

Section 50

Force Majeure

IBACTP will not be liable for delay or failure caused by circumstances beyond its reasonable control, including:

  • Natural disaster;
  • Severe weather;
  • Fire;
  • Flood;
  • Epidemic or pandemic;
  • War;
  • Terrorism;
  • Civil unrest;
  • Government action;
  • Labor disruption;
  • Utility failure;
  • Internet or telecommunications failure;
  • Cyberattack;
  • Cloud-service disruption;
  • Payment-network failure;
  • Transportation interruption; or
  • Failure of an essential third-party provider.

IBACTP will make reasonable efforts to restore affected services and provide an appropriate alternative when practical.

Section 51

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Mandatory consumer protections or other nonwaivable rights available under the law of your place of residence remain unaffected.

Section 52

Informal Dispute Resolution

Before filing a legal proceeding, you and IBACTP agree to make a good-faith effort to resolve the dispute informally.

A written dispute notice should include:

  • Your name and contact information;
  • The account, transaction, certification, or service involved;
  • A description of the dispute;
  • Supporting information;
  • The relief requested; and
  • Any prior attempts to resolve the matter.

Send the notice to admin@ibactp.org with the subject line “Formal Dispute Notice,” or mail it to IBACTP Headquarters.

The receiving party will have at least 30 days to review and attempt to resolve the dispute before either party initiates litigation, unless immediate action is necessary to protect intellectual property, confidential examination content, security, safety, or legal rights.

Section 53

Jurisdiction and Venue

Unless applicable law requires otherwise, legal proceedings arising from these Terms or an IBACTP service must be brought in a court of competent jurisdiction located in Dallas County, Texas.

You and IBACTP consent to the personal jurisdiction of those courts.

This section does not prevent either party from seeking urgent injunctive or protective relief in another appropriate jurisdiction when necessary to protect confidential information, examination content, intellectual property, security, or safety.

Section 54

No Mandatory Arbitration Unless Separately Agreed

These Terms do not impose mandatory binding arbitration.

If IBACTP and another party enter a separate signed agreement containing an arbitration provision, that provision will govern disputes within its defined scope.

Section 55

Time Limit for Claims

To the extent permitted by law, a claim arising from these Terms or an IBACTP service must be filed within one year after the claimant knew or reasonably should have known of the event giving rise to the claim.

This limitation does not apply where applicable law prohibits shortening the statutory period.

Section 56

Severability

If a court determines that any provision of these Terms is invalid or unenforceable, that provision will be enforced to the maximum extent permitted or modified only as necessary to make it enforceable.

The remaining provisions will remain in effect.

Section 57

Waiver

A failure by IBACTP to enforce a provision does not waive its right to enforce that provision later.

A waiver is effective only when made in writing by an authorized IBACTP representative.

Section 58

Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written approval from IBACTP.

IBACTP may assign its rights and obligations in connection with a merger, restructuring, financing, transfer of assets, organizational succession, or similar transaction, subject to applicable law.

Section 59

No Third-Party Beneficiaries

Unless expressly stated otherwise, these Terms do not create rights for any person or entity other than you and IBACTP.

Section 60

Relationship of the Parties

These Terms do not create:

  • An employment relationship;
  • An agency relationship;
  • A franchise;
  • A legal partnership;
  • A fiduciary relationship;
  • A joint venture; or
  • Authority for you to bind IBACTP.

Certification does not make a credential holder an employee, agent, representative, or spokesperson of IBACTP.

Section 61

Entire Agreement

These Terms, together with applicable:

  • Privacy policies;
  • Candidate handbooks;
  • Examination rules;
  • Codes of ethics;
  • Purchase terms;
  • Refund policies;
  • Partner agreements;
  • Credential-use policies; and
  • Program-specific terms,

constitute the agreement governing the relevant IBACTP service.

They replace prior discussions or representations concerning that service, except for a signed written agreement expressly preserved by the parties.

Section 62

Order of Precedence

If applicable documents conflict, the following order generally applies:

  • A signed written agreement between IBACTP and the relevant party;
  • Program-specific or purchase-specific terms;
  • The applicable Candidate Handbook or Partner Agreement;
  • The IBACTP Code of Ethics and credential-use requirements;
  • These Terms of Use; and
  • General website content.

The Privacy Policy controls issues specifically concerning personal-information processing unless a lawful, more specific data-processing agreement applies.

Section 63

Changes to These Terms

IBACTP may update these Terms to reflect changes in:

  • Law;
  • Technology;
  • Certification requirements;
  • Examination delivery;
  • Security practices;
  • Programs;
  • Vendors;
  • Business operations; or
  • Organizational policies.

The revised Terms will be posted with an updated “Last Updated” date.

When a material change affects registered candidates, credential holders, paid services, or partners, IBACTP will provide additional notice where reasonably appropriate or legally required.

Changes apply prospectively unless law or security requirements require immediate application.
